Change Description

This PR removes deadcode found by running golangci-lint run --no-config.

Motivation and Context

This opportunity for improvement was discovered while working on PR #9455.

just for future (to prevent close/re-open notifications), if you want to re-run the CI, you can instead just re-push your commits by going git commit --amend (which will just update the timestamp of the top commit) and then re-push the branch.

you can also just re-run individual tests through the UI
